AxiSend

Terms of Service

Effective date: July 30, 2026

If this translation differs from the Korean original, the Korean original prevails.

1. Purpose

These Terms govern the conditions for using AxiSend, provided by AXIMUM Inc. (“Company”), and the rights, duties, and responsibilities of the Company and its users.

2. Definitions

  1. “Service” means AxiSend’s company inquiry-form discovery, customer-data management, automated message entry and submission, scheduling, result review, credit, and payment features.
  2. “User” means a person or entity that agrees to these Terms and uses the Service through an account or workspace.
  3. “Credits” are electronic usage units for paid features such as submissions; they are not cash or financial products.
  4. “Submission” means automatically entering and submitting information designated by a User to a target company’s website or form provider.

3. Effect and changes

These Terms take effect when posted in the Service or delivered electronically. The Company may amend them as permitted by law and will announce the effective date and reason before a material amendment takes effect.

Material changes adverse to Users will receive reasonable advance notice unless applicable law prescribes another method or period.

4. Agreement and age requirement

You must be 19 years of age or older to register for the Service or make paid purchases. A person acting for an organization represents that they have authority to bind it to these Terms.

The Company may reject or terminate an account involving false information, impersonation, or a material risk of violating law or these Terms.

5. Account management

Users must provide accurate, current information and secure their accounts, passwords, and authentication methods. Suspected sharing or compromise must be reported promptly.

The Company is not liable for loss caused by a User’s failure to secure an account unless the Company acted intentionally or negligently.

6. Service description

The Service provides inquiry-form discovery; customer, message, and input-profile management; automated form entry and submission; scheduling; results and automation evidence; and credit and payment features.

Discovery, detection, and submission results may be affected by the target website’s structure, network, and security controls.

7. User data and legal compliance

Users must hold the rights and lawful basis required for companies, contacts, contact details, campaign messages, and other data they register or upload.

Users must comply with advertising, privacy, electronic communications, and consumer laws in every destination country, as well as recipients’ opt-out wishes. AxiSend’s automated detection or blocking does not replace the User’s legal review.

8. Prohibited conduct

Users must not:

  • use the Service for unlawful, fraudulent, deceptive, impersonating, spam, or rights-infringing activity;
  • submit messages after learning that the recipient has opted out;
  • market products or services without required registration, permits, or certification;
  • market illegal tangible or intangible products or services, including those reasonably suspected of being unlawful; or
  • bypass security or limits, send abnormal bulk requests, distribute malware, or otherwise impair the Service.

9. Restrictions and legal action

If a violation is established or reasonably suspected, the Company may stop submissions, remove content, and restrict or suspend the account. When necessary, it may report the conduct to authorities and take civil or criminal legal action.

Unless an urgent risk requires immediate action, the Company will explain the reason and provide a reasonable opportunity for the User to respond.

10. Credits and payments

Users may purchase Credits according to the displayed package, price, currency, and payment terms. Payments follow the procedures and policies of the Company’s designated payment processor.

Credits may not be transferred or pledged without prior consent and cannot be used as cash outside the Service except where required by law.

11. Advance deduction and restoration

When a submission job starts, the Company deducts in advance the Credits required for the number of targets.

Credits for targets whose submissions are not completed because of failure, interruption, or another cause are automatically restored.

Credits used for normally completed submissions are non-refundable. If a target was marked complete and charged but was not actually submitted, the User may dispute it and request restoration or a refund.

12. Cancellation and refunds

Within 7 days after purchasing Credits, a User may request a refund of the remaining Credits after excluding Credits already used.

General refund requests must be sent to [email protected] and will be processed within 7 business days after receipt.

Refunds are made to the original payment method when possible; otherwise, the Company will agree on another method with the User.

A shorter statutory deadline or broader consumer right prevails. These Terms do not limit statutory cancellation or refund rights when the Service differs from its description, advertising, or contract.

13. Service changes and interruption

The Company may change or temporarily interrupt all or part of the Service for operational or technical reasons. Material effects will be announced in advance unless an urgent outage or security issue makes prior notice impracticable.

14. Intellectual property

Rights in the Service, software, interface, marks, and Company materials belong to the Company or their lawful owners. Rights in User-provided data and content remain with the User or original owner.

Users authorize the Company to process User data only as needed to provide and secure the Service, address errors, and comply with law.

15. Termination

Users may request termination through the Service or at [email protected]. They must review unpaid balances and pending submissions; data handling follows the Privacy Policy and applicable law.

16. Limitation of liability

The Company is not liable for loss caused by events it cannot reasonably control, including disasters, network failures, target-site changes or blocks, and inaccurate User data. This does not exclude liability for intentional acts, gross negligence, or liability that law does not permit the Company to limit.

Users are responsible for the final legality review of recipients and messages and, absent fault by the Company, for third-party disputes caused by their unlawful submissions.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea. The parties will first attempt good-faith resolution; unresolved disputes may be brought before a court having jurisdiction under applicable law.

18. Contact and effective date

Questions about these Terms, Credits, or refunds may be sent to [email protected].

These Terms are effective July 30, 2026.
